Bangalore: The Karnataka High Court upheld the disqualification of the 11 Bharatiya Janta Party (BJP) rebel MLAs on Friday. The 11 BJP MLAs had been disqualified by state Assembly Speaker KG Bopaiah.
The much awaited verdict came as relief for the BS Yeddyurappa government. Yeddyurappa's advisor K Diwakar called the High Court's decision a huge victory.
"It is a huge victory for us. We won a constitutional battle," said Diwakar.
However, Janata Dal-Secular said that it would challenge the High Court decision upholding the disqualification of the MLAs in the Supreme Court.
Justice VG Sabhahit, the third judge to whom the two-member division bench had referred the matter, concurred with the decision of the Chief Justice JS Khehar, on the Speaker's order.
Justice Sabhahit remitted the matter back to the two-member division bench headed by the Chief Justice.
The case was posted before Justice Sabhahit after a division bench, comprising Chief Justice J S Khehar and Justice N Kumar gave a split verdict.
While Justice Khehar upheld the Speaker's ruling, Justice Kumar set aside the disqualification order. After hearing counsels for both parties, Justice Sabhahit reserved for orders on October 21.
