Supreme Court to Pronounce Judgement on Constitutional Validity of Article 370 on Monday
The Supreme Court had reserved its verdict in the case after extensive arguments by both the petitioners and the government over a span of sixteen days in September

The Supreme Court will pronounce its judgement in the case challenging the Centre’s decision to repeal the special status of Jammu and Kashmir under Article 370 of the Constitution on December 11 (Monday).

The Constitution bench of the apex court, led by Chief Justice of India DY Chandrachud and comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant, had reserved the judgment in the matter on September 5 after a marathon hearing for 16 days.

Several petitions have been filed challenging the orders passed on August 5, 2019, on the ground that they are unconstitutional.

During the course of the hearing, the top court had heard Attorney General R Venkataramani, Solicitor General Tushar Mehta, senior advocates Harish Salve, Rakesh Dwivedi, V Giri and others on behalf of the Centre and the intervenors defending the abrogation of Article 370.

Senior advocates including Kapil Sibal, Gopal Subramanium, Rajeev Dhavan, Zaffar Shah, Dushyant Dave and others had argued on behalf of the petitioners.

The apex court had taken up this case for hearing after a delay of almost four years. Several petitions challenging the abrogation of Article 370 and the Jammu and Kashmir Reorganisation Act, 2019 that divided the erstwhile state into two union territories – Jammu and Kashmir, and Ladakh – were referred to a five-judge Constitution Bench in 2019 by a three-judge bench led by former CJI Rajan Gogoi.

In March 2020, when the court heard the matter, a five-judge bench presided by Justice NV Ramana refused to refer the case to a larger bench.
