KOCHI: The Kerala police are all set to approach the Supreme Court to transfer the case related to the assault on two Malayali engineering students on a moving train near Erode railway station in January, from Tamil Nadu to Kerala.  A decision in this regard was taken as the Kerala police’s request to transfer the case from Tamil Nadu failed to make any headway. The Kerala police, under the directive of Chief Minister Oommen Chandy, had constituted a special investigation team (SIT) and a case was registered in Kerala in this regard. However, since an assault case was first registered in Tamil Nadu, a similar case in Kerala may not stand legal scrutiny. A top official, who was part of the special investigation team, told ‘Express’ that they had requested the government to approach the Supreme Court to get the the case transferred to Kerala. “The SIT and the DGP had written to the Tamil Nadu police to transfer the case to us. But the Tamil Nadu police have not responded to our request so far. No proper investigation has been conducted into the incident that took place in Tamil Nadu. “As a last resort we would approach the Supreme Court to get the case handed over to us. Negotiations at the government level will not yield results as the two states are not on good terms because of the Mullaperiyar issue,” the police officials said.  The FIR registered by the Mulanthuruthy police has named Akhil Babu of Ochira, Kiran Nair of Parasala, Ebin Babu of Malappuram, Tintu Abraham of Uzhavoor and four other unidentified persons as the accused. According to the SIT, the accused used to create nuisance on the campus and public places. “They regularly attacked other students. Money and other valuables were snatched from junior students. Alcoholism was regular among the group and some of them used drugs. Because of the physical and psychic terror imposed by them junior students were afraid of travelling on trains. Fearing that the miscreants were on the train, Geeverghese John and Arun Raj boarded the train from Erode instead of Salem which was the nearest railway station from the college,” the police official said. All the accused persons in the case are absconding.Geeverghese John and Arun Raj, two students of a Tamil Nadu engineering college, were brutally assaulted by their seniors on a Kerala-bound train on January 13. The  seniors, most of them in an inebriated condition, demanded their ATM cards and money. When the students refused to do so, they were attacked with blades and iron rods causing severe injuries to them.
