BANGALORE: The Lokayukta Special Court heard the corruption case against former chief minister B S Yeddyurappa, his kin and others on Friday and adjourned further hearing to Saturday.Judge K N Sudheendra Rao heard the arguments of counsels of the complainant Sirajin Basha and the accused relating to the allegations of illegal denotification of lands at Uttarahalli, Agara and Anekal by BSY and others.In this case, there are ten accused, including Yeddyurappa, his sons B Y Raghavendra and B Y Vijaynendra, son-in-law Sohan Kumar, MLAs Hemachandra Sagar and Krishnaiah Shetty and others.The judge first heard the argument of Shankarappa, counsel for the tenth accused, MLA Hemachandra Sagar, about his bail plea.He argued that Sagar and his brother Premachandra Sagar, who were directors of Sahyandri Health Care Private Limited along with Yeddyurappa’s two sons, had resigned from the post on March 2, 2010.The company’s yearly report mentions this, he said.The accused kept himself away from the activities of the company and has no investment in the company.One Murudeshwara company has invested `2 crore and Indivara Kuteera has invested `1.5 crore in the Sahyadri Healthcare.Hemachandra Sagar has no role in this money transaction.The allegation of involvement in the denotification of lands in Uttarahalli is also baseless, Shankarappa argued.“The accused has been appearing before the court proceedings of this case regularly.I request the court to grant bail,” he said.Counsel for Yeddyurappa argued that the denotification of major part of the land took place in 2007, hence the court has to summon the then CM too to court.The case has been filed to sully Yeddyurappa’s image, he said.HEARING ON BSY PLEA POSTED TO MONDAYBANGALORE: The High Court on Friday adjourned the hearing of petition filed by former chief minister B S Yeddyurappa seeking to quash the lower court proceedings against him till Monday.Yeddyurappa in his submission stated that the respondents Sirajin Basha and Balraj had obtained sanction from the Governor to file one complaint against him, but had instead filed five complaints without obtaining sanction.Senior advocate Jaykumar S Patil who appeared on behalf of Yeddyurappa argued that the lower court has issued summons to the former CM without holding any inquiry into the private complaints through concerned investigative authorities.He also contented that the complainants have registered the complaints beyond the limits of sanction accorded to them.“Charges such as forgery, cheating, creating fake documents and few others under the IPC has been registered and the court has wrongly taken cognizance of those charges as well,” the advocate argued.When the advocates for the complainants sought adjournment till Wednesday, Justice B S Patil refused the same and posted it to Monday.
