CHENNAI: The election of Congress candidate M Rajasekaran from Thottiyam Assembly constituency in Tiruchy district in 2006, was upheld by the Madras High Court, on Friday. Dismissing MDMK candidate R Natarajan's petition challenging the election, Justice P Jyothimani on Friday observed that this court was unable to grant any relief for various reasons. A prima facie case had not been made out by the petitioner in respect of the irregularities. The term had also come to an end and fresh elections have been conducted on April 13 last. The returning officer also retired long before the commencement of the trial, the judge pointed out. Before parting with the case, the judge said that in terms of the basic object of the Representation of People Act, the ballot papers should be preserved, especially when the election result was under challenge.
