CHENNAI: In a legal drubbing to AIADMK government in Tamil Nadu, Madras High Court today stayed the recent amendment to Uniform System of School Education Act, providing for indefinite postponement of implementation of new education system introduced by previous DMK government.Disposing a batch of petitions, the First Bench, comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam however said "the order of stay shall not operate as a bar for the government to conduct a detailed study of the common syllabus and common text books".The Bench said "we are prima facie satisfied that amending the Act, in effect repeals or indefinitely puts on hold the implementation of the Parent Act. At this stage, it is to be borne in mind that the Parent Act has already been implemented insofar as Class I and VI from the academic year 2010-11."To revert to the position prior to 2010-11 would be violating the decision of the Division Bench and would have the effect of repealing the Parent Act. At this stage, such reversion should not be permitted as the same would not be for the welfare the student community", the judges said."In respect of other classes- standards II to V and VII to X, it has been stated that substantial work has been done for introduction of the new syllabus and printing the textbooks and the same has already been made available to students by publishing it in the official website".The bench opined that if the impugned Amending Act was to be given effect to, it would result in unsettling various issues and the interest of the children would be jeopardised.The AIADMK government brought the amendment on the plea that text books prepared for it were mere propaganda materials of previous DMK regime printed using the state funds.
