Radhakrishnan did not dispute the fact that 50 per cent of the vacant posts had to be filled up by way of promotions and for filling up the remaining posts, there should be a public notification. After following the rules of promotion, the remaining vacancies in the posts of assistants, typists and readers/examiners in the Madras High Court and its Bench at Madurai will be filled in only by way of public notification, in accordance with the procedure prescribed in the Rules, the first bench of the Madras High Court has said.
