After following the rules of promotion, the remaining vacancies in the posts of assistants, typists and readers/examiners in the Madras High Court and its Bench at Madurai will be filled in only by way of public notification, in accordance with the procedure prescribed in the Rules, the first bench of the Madras High Court has said.
The bench comprising Chief Justice MY Eqbal and Justice TS Sivagnanam gave a direction to this effect on Monday, while disposing of a public interest writ petition from advocate P Pugalenthi.
Petitioner’s counsel M Radhakrishnan’s apprehension was that the postswould be filled in without resorting to public notification in newspapers having wider circulation.
After listening to the submissions of advocate R Suresh Kumar, representing the Registrar-General, the bench observed that the apprehension of the petitioner that these posts might be filled up without public notification, was wholly misconceived.
Radhakrishnan did not dispute the fact that 50 per cent of the vacant posts had to be filled up by way of promotions and for filling up the remaining posts, there should be a public notification.
Hence, the direction.
