New Delhi: The Supreme Court has postponed a hearing on a petition by Shaukat Hussain Guru in the Parliament attack case till February.
Shaukat had challenged his conviction and ten-year sentence, saying he was denied an opportunity to defend himself.
The apex court postponed the hearing to allow the Government to file its affidavit in the matter.
Shaukat was awarded the death sentence by the trial court along with Mohammed Afzal Guru for the December 13, 2001 terrorist attack on Parliament.
While the apex court commuted his sentence to ten-year imprisonment, it upheld the death sentence of Afzal Guru. Afzal's mercy plea is pending with the President.
He is challenging his conviction and sentence on the grounds that the offence for which he has been sentenced was never alleged against him and no charges framed against him under the section.
According to him, without having been given an oppurtunity for defending himself, he could not have been sentenced for the offence.
In all, nine people, including the militants who had attacked Parliament, were killed.
