New Delhi: The Supreme Court issued a contempt notice to BJP MLA from Delhi Harsharan Singh Balli for breaking open the shops sealed by the Municipal Corporation of Delhi (MCD).
The MCD is carrying out a demolition and sealing drive in Delhi against commercial establishments operating in residential areas on the orders of the apex court.
A Bench headed by Chief Justice Y K Sabharwal issued the notice after the Monitoring Committee brought to its notice a videotape showing Balli breaking seals of shops.The bench also asked Balli to submit a defence.
Making it clear that the ongoing sealing drive would continue, the bench said that no court would entertain any petition on the ongoing sealing drive since the matter was being heard by the Supreme Court.
On the Monitoring Committee’s recommendation, the bench directed the MCD to issue requisite public notice with regard to the action against commercial establishments running from residential premises.
Sheduling the next hearing for July 17, the court asked the MCD to file an affidavit within four weeks about those sealing orders.
Furthermore, the apex court has asked the Monitoring Committee to give its perception of small shops in the next report.
In addition, it has to examine the impact of Urban Development Ministry`s mixed land use notification issued on March 28 on the infrastructure and facilities like water, electricity and sewage.
