CHENNAI: The Madras High Court on Friday clarified that its earlier interim order passed on November 4 this year granting a stay would amount to restraining the State from proceeding to make any construction for the purpose of shifting the Anna Centenary Library from Kotturpuram to the DPI campus in Nungambakkam.Conceding a plea from Advocate General A Navaneethakrishnan seeking time to file counter, the first Bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam posted to Jan 19, 2012, further hearing on the batch of petitions from advocate P Pugalenthi, Manonmani, Kavignar Illayabharathi and three others.The Bench said that the interim direction passed on November 4 was to the effect that until further orders, the decision taken by the government to shift the library should remain stayed. “Let it be made clear that this interim direction amounts to forbearing the State from proceeding to make any construction for the purpose of shifting the library. The present library shall function, as it is, without any sort of interference,” it added.Appearing for Kavignar Ilayabharathi, senior counsel P Wilson contended that after the policy decision and the GO, the authorities were not providing substantial financial assistance to the library for its smooth functioning. A large number of citizens from all walks of life had benefited from the establishment of library. There were lot of unnecessary restrictions on the public to have access. Police personnel had been posted and unnecessary regulations were enforced on the users of the library.
