New Delhi: Supreme Court on Wednesday upheld the Andhra Pradesh High Court decision that there should be no reservation for Muslims in government jobs, schools and colleges.
The Andhra Pradesh High Court had, in December 2005, quashed a state government ordinance providing 5 per cent reservations for Muslims in Government jobs and educational institution.
However, the Bench, headed by Chief Justice Y K Sabharwal, gave relief to those who have already availed the benefit under the previous law, asking for a status quo on 300 admissions already made in various medical colleges and appointments made in the public services.
Admitting a bunch of appeals against the High Court judgement, the Bench referred the matter for consideration before a Constitution Bench.
A five-judge Constitution Bench of the High Court on November 7 had pulled up the state Backward Classes Commission, whose report had formed the basis for the quota policy. It had observed that the Commission had given 'defective advice' to the government and had failed to evolve reasonable criteria to categorise Muslims as Backward Class.
The High Court had said the Commission did not do its job properly and could not produce sufficient material to suggest that the entire Muslim community was socially and educationally backward.
