Islamabad (Pakistan): India prisoner Sarabjit Singh in Pakistan has his mercy plea pending before the Pakistan President Pervez Musharraf.

His lawyer on Friday hoped the General would take a sympathetic view towards his review petition against the death sentence.

The Supreme Court due to the jail authorities' negligence had rejected the petition.

The SC in September 2005 had rejected his review petition in the Yakki Gate explosion case while another review application of Sarabjit, condemned to death for his alleged involvement in four bomb blasts in Pakistan in 1990, was still pending before the apex court.

Following the dismissal of the review petition in the Yakki Gate case, Sarabjit's lawyer Rana Abdul Hamid also filed a mercy petition before Musharraf.

Blaming negligence on the part of the prison and Home Department officials of Punjab province for the dismissal of Sarabjit's review petition, Hamid hoped the President would sympathise with his client's plight and spare his life.

Musharraf is expected to take a decision on Sarbjit's mercy petition after the apex court delivers a judgement on his other review petition in connection with three more bomb blast cases.

Hamid said prison authorities had not informed Sarabjit in time to file the review application in the Yakki Gate case.

His application was dismissed not on merit but on technical grounds, the lawyer said.

Hamid added that Sarabjit Singh was a foreigner, and the prison manual clearly stated that jail authorities would be responsible for the timely filing of the appeal of a foreign inmate.
