KOCHI: The Kerala High Court on Wednesday directed the state government to explain its authority to tamper with the list of candidates selected for the post of members of the Kerala Administrative Tribunal (KAT).The government had decided to withdraw two High Court advocates Ashok M Cherian and A V Asha from the proposed list prepared by the selection committee.The court directed the Centre to inform as to why it had not cleared the names of all the selected members. It also directed the Assistant Solicitor General to collect information from the Union Ministry concerned regarding the denial of approval to two of the five selected.A Division Bench comprising Justice C N Ramachandran Nair and Justice K Vinod Chandran passed the order on a petition filed by A G Basil of Ernakulam and others challenging the implementation of KAT and the appointment of Justice K Balakrishnan Nair as its Chairman.The court adjourned the hearing of the case to January 6.The court observed that since the state government had withdrawn two names from the list of candidates selected by the selection committee constituted under Rule 3(2) of the Administrative Tribunal (Procedure for Appointment of Vice-Chairman and Members) Rules-2006, the Centre should explain whether the State government could withdraw the names from the selected list.The selection committee consisted of the Chief Justice of the Kerala High Court, Chief Secretary, Chairmen of the KAT and Public Service Commission.
