Delhi Court Orders Woman to Pay Rs 15 Lakh for Defaming Ex-Husband, Sending Him Derogatory Emails
The man claimed that his ex-wife used highly objectionable language in her communications with friends and relatives, damaging his reputation.

In a recent ruling on July 29, a Delhi court found a woman guilty of defaming her ex-husband and ordered her to pay Rs 15 lakh in damages. The decision came after the man claimed that the woman’s actions caused him significant personal and professional harm. The case, adjudicated by Saket District Court Judge Sunil Beniwal, centered on allegations that the woman repeatedly harassed her ex-husband by sending him derogatory emails and causing him significant emotional and financial distress.

The court heard that the woman’s actions led to the ex-husband suffering from a health condition that required a Rs 6 lakh surgical treatment. Additionally, the woman’s emails were found to contain offensive remarks about her ex-husband and his family, including his elderly maternal uncle.

The ex-husband, who had previously filed a petition seeking damages for defamation, claimed that the woman’s actions prevented him from seeing his daughter, depriving him of his paternal rights and emotional connection with her. He also claimed that the woman used highly objectionable language in her communications with friends and relatives, further exacerbating the damage to his reputation.

In her defence, the woman argued that the claims were false and intended to harass her. She also contended that the case was barred by legal limitations, as it was based on incidents from 2010 and emails from 2020.

The couple, who married in 2001, had their marriage dissolved in 2021 by a family court under the Hindu Marriage Act, 1955, on grounds of cruelty. The husband alleged that the ex-wife left their home in 2009 with their daughter and subsequently filed defamatory cases against him and his family members. Even after their divorce, the ex-wife continued to send disparaging emails to the husband’s elderly maternal uncle, who was also his employer.
