KOCHI: The Kerala High Court on Friday ordered  further investigation into the death of Jessy and her child, setting aside a trial court order acquitting eight accused in the case.A Thrissur Sessions Court had acquitted the accused on benefit of doubt. The prosecution case was that Jessy had committed suicide consuming Sodium Cyanide after poisoning the child. The trial court committed a serious error in acquitting the eight accused, including Jessy’s husband and his relatives, Justice K Hema said, passing the order on a revision petition filed by Jessy’s father Joseph, and an appeal filed by the state government.The court observed that prosecution records rule out the possibilities of death by poisoning. No poison was detected in blood or viscera and no poison was detected in the steel vessel seized from the scene of occurrence. This is a fit case in which reinvestigation ought to have been ordered, the court said. “It is not too late to ascertain even now by a proper investigation what was the actual cause of deaths. Without further investigation a right decision cannot be taken,” the court held.The trial court had earlier acquitted Antony alias Antu, Rosy, Sherly, Moly, Rosly, Paulose, Lilly and Sicilly.
