Kohima: The three MLAs of Nagaland Legislative Assembly, who were disqualified by the Speaker on August 25, have filed a petition in the Kohima Bench of the Gauhati High Court against the order.
The three NCP MLAs, Imtilemba Sangtam, Dr TM Lotha and Mmhonlumo Kikon, had switched sides to the BJP on June 16 last claiming to have fulfilled all the laid down provisions under the Tenth Schedule of the Anti-Defection Law of the Constitution.
The first hearing was held on Tuesday, but the court deferred its judgement as the counsels for the respondents sought permission of a few days to reply to the points submitted by the advocate of the plaintiffs. The next hearing has been fixed for Friday, official sources said on Wednesday.
Meanwhile, senior Supreme Court lawyer and ex-MP Satya Pal Jain, who represented the three MLAs, termed the Assembly Speaker's decision as "unconstitutional" and challenged the disqualification order issued on August 25.
