CHENNAI: The Madras High Court has imposed a cost of Rs 50,000 on CR Manikandan, a clearing and forwarding agent on parcel handling, for filing writ petitions under one pretext or the other and thereby enjoying the benefits arising out of an interim order obtained earlier for about five years. ‘‘The relief claimed by the petitioner is not only frivolous, but it had reached finality by a subsequent order passed by this court on Oct 29, 2010. In the said facts and circumstances of the case, this court imposes a cost of Rs 50,000 on the petitioner to be paid to railways,’’ Justice K Chandru observed on Feb 6 last.Originally, Manikandan filed writ petitions to quash a notification dated March 7, 2007 inviting tenders and to maintain the existing contractors till such time guidelines were framed for clearing and forwarding agency on parcel handling by the proper authority. The HC, passing an interim order on April 25, 2007, directed the railways to maintain status quo. Passing final orders on the writ petitions, Justice Chandru said the petitioner had so far filed five writ petitions one after the other right from 2004. Petitioner’s allegation that there would be heavy loss to the railways was projected only to obtain interim orders.
