Mumbai: Abu Salem may have killed hundreds of Indian citizens but he will not be executed or be jailed for the rest of his life.

MEA sources have told IBN that the then NDA government had given an assurance to the Potruguese government that if extradited, India would sentence Salem and Monica Bedi either to life imprisonment or award the death penalty.

According to Salem's lawyer, Portugal, while acceding to to Indian request for extradition of Salem, had put two conditions that in case of conviction he would not be awarded Capital punishment and that he would not serve a jail term exceeding 25 years.

On Friday, the tricky issue raised its head at the designated TADA court in Mumbai, when the court asked how the CBI was producing an accused in the court with a pre-condition.

TADA Judge P D Kode asked CBI if there was any legal provision that could allow them to produce an accused in court with a precondition.

The CBI promptly withdrew its submission on the subject saying they would argue on the issue at an appropriate stage.

The judge later allowed the CBI to submit documents relating to these conditions for extradition.
