THIRUVANANTHAPURAM: The CBI Court here on Friday observed that ‘sexual abuse cannot be proved without the presence of witnesses and evidence’.Special Judge T S P Moosath made this reference while hearing the argument in the petition filed by T P Nandakumar seeking cancellation of further investigation report in Kaviyoor case and ordering another investigation by an expert team, monitored by both the CBI court and the High Court. The court, which heard the argument by the CBI on Friday, would pronounce its judgment on March 30. “Latha Nair is the only person responsible for the death of the five-member family and there are no VIPs  or politicians involved in the case,” the CBI stated.CPM leaders and former ministers Kodiyeri Balakrishnan and P K Sreemathi were interrogated as part of the investigation. “The CBI did not probe into the letter allegedly written by one Sreekumari as the earlier investigating officer in the case R Sreelekha could not find the address of the sender,” stated K P Satheesan, the CBI counsel.The CBI had submitted a further investigation report in the CBI court on December 16, 2011, stating Narayanan Namboothiri had sexually abused his daughter Anagha two days before their death.The report filed by CBI S P Nandakumar Nair had pointed fingers at the father without conducting the DNA test of the samples and based on the statement of a friend of the victim as well as circumstantial evidence.Anagha, along with her father, mother Sreedevi, sister Akhila and brother Akshay were found dead in their rented house at Kaviyoor near Thiruvalla on September 28, 2004.
