Once minority status is given to an institution, it cannot be disturbed, unless there is a change in society/trust or violation of its constitution or memorandum of association (MoA), the HC has ruled.

Justice N Paul Vasanthakumar made the observation while allowing a writ petition from Loyola College, seeking to quash an order dated Oct 8, 2007 of the Higher Education Secretary granting minority status to it for 5 years upto 2012.

According to advocate Isaac Mohanlal, the college, which was all along recognised as a minority institution, was asked by the DCE to get a separate order recognising its minority status after a 1998 GO. Accordingly, the college did every year. In 2007, the government granted minority status for five years till 2012. The college preferred the present petition as its status was expiring this year.

Justice Vasanthakumar held that minority status already granted was valid without any restriction. If there was change in educational agency or if the institution was run contrary to MoA, it was open to government to issue notice and pass fresh orders.
