GULBARGA: Gulbarga Assistant Commissioner Sangappa has sent a report over the takeover of the famous Gulbarga Shri Sharanabasaveshwara Temple by suppressing facts, according to records with Express. The office of Gulbarga Deputy Commissioner sent several letters to Gulbarga AC to look into the demands of several persons, including Prof Shivraj Patil and former corporator Prakash Benakanahaali, to take over the shrine under the Endowment Department as 317 temples in Gulbarga including were notified in the gazette and submit the report at the earliest. The AC then sent notices to the temple authorities and the complainant and conducted a hearing on July 20. Senior advocate Nisti who appeared on behalf of the temple argued that the Supreme Court has granted a stay through IA No 7 of 2008, Special Leave to Appeal [Civil] No 5398/2007 and A 8-10 in Civil Appeal No 5924/2008 of Section 25 of the Karnataka Hindu Religious Institution and Charitable Endowments Act, 1997, and it could not be heard as the Apex Court has given a stay. The AC in his report submitted to the DC on August 22 has taken the support of the temple advocate’s argument and documents furnished by him and has stated in the report that no hearing could be done as the case is pending with the SC. But as per records with Express, the SC on July 31, 2009, vacated the interim order dated April 2, 2007, and disposed off special leave to appeal (Civil number 5398/2007). It means the government could enforce Section 25 of the Act which allows the Constitution of committees of management to the temples inviting applications from the devotes and the general public for constituting the administrative committee consisting of nine members for a period of three years for administration. AC Sangappa he said that he came to know about the court vacating the stay through Express. and would look into the matter.
